Description
Artificial Intelligence Note-Takers: Ethics, Compliance, Privacy, and Legal Guardrails for Investment Advisers
Investment adviser representatives are increasingly using artificial intelligence (“AI”) note-taking tools to record, transcribe, and summarize client meetings. While these tools may offer efficiency benefits, they also introduce significant ethical, compliance, privacy, and legal risks if used without appropriate guardrails.
This course examines the ethical and fiduciary considerations associated with the use of AI note-takers by investment adviser representatives and supervisory personnel. Participants will learn how existing regulatory obligations—rather than new technology rules—govern the appropriate use of these tools. The course focuses on practical, real-world scenarios involving client consent, accuracy of AI-generated records, safeguarding nonpublic personal information, vendor due diligence, recordkeeping obligations, and supervisory oversight.
The course emphasizes that AI note-takers may be used only if specific compliance, privacy, and legal controls are in place. Participants will gain a clear understanding of how regulators are likely to evaluate the use of AI note-taking tools during examinations and investigations, and how ethical decision-making and professional judgment remain central to an adviser’s responsibilities regardless of technology used.
This course is designed for both front-line investment adviser representatives and supervisory personnel and is intended to reinforce ethical standards, fiduciary duty, and investor protection in an evolving technological environment.
Learning Objectives
Upon completing this course, participants will be able to:
- Identify ethical and fiduciary risks associated with the use of artificial intelligence note-taking tools in client and internal meetings.
- Recognize when client notice and consent are required before recording, transcribing, or summarizing meetings using AI-based tools, including considerations under federal and state recording laws.
- Evaluate the accuracy risks of AI-generated transcripts and summaries, and explain why human review and professional judgment remain essential to meeting fiduciary obligations.
- Apply best practices for reviewing and approving AI-generated meeting summaries, including the role of both the investment adviser representative and the client in verifying accuracy.
- Describe privacy and confidentiality risks posed by AI note-takers, including the handling of nonpublic personal information and the ethical obligations imposed by Regulation S-P.
- Assess vendor-related risks, including cybersecurity controls, data storage practices, breach notification obligations, and the potential use of recordings or transcripts to train AI models.
- Determine recordkeeping obligations for audio recordings, transcripts, summaries, and related outputs under the Books & Records Rule and ethical standards of professional responsibility.
- Explain supervisory responsibilities related to the approval, monitoring, and oversight of AI note-taking tools within an investment advisory firm.
